EXPERT WITNESS SERVICES

Overview

Representing the owner, the contractor, or the architect,  we provide forensic expert analysis and testimony.

Review

  • Discuss the particulars of the case to determine if I am a good fit for the case.
  • Sign a Consultation agreement & receive a retainer.
  • Perform an initial site inspection to provide documentation of existing conditions.
  • Review the contract documents, the contract, specifications, plans , RFI’s, Change Orders, photos, & communications.

Analyze

Determine the Contract Price and how much was paid – a simple question, yet it is surprising how often neither party to the dispute has tracked that information.

 

  • Forensic accounting.
  • Compile all the executed contracts and change orders to establish the (Total) “Contract Price”.
  • Compile and account for all the payments made towards the contract price.
  • Establish how much would still have been due, if any, had the project been completed to satisfaction.
  • Provide additional site inspections as required.
  • Analysis and adherence to the contract documents.
  • Conform to the standard of care and practices accepted in the construction industry. 
  • Provide destructive testing if and as required.
  • Determine what portions of the Contract Work have not been completed, or not completed correctly, or not in accordance with the contract documents.
  • Schedule delay analyses.
  • Establish repair scope protocol.
  • Recommend proposed deposition questions.
  • Assist clients through the mediation, arbitration, and litigation processes.

Document

  • Produce a thorough, detailed report delineating the findings and the recommended remedial work required to complete or repair the project.
  • Financial damage valuations - provide Estimates to complete work and perform required repairs.
  • Based on those Estimates, deduct the cost of completion and repairs from the amount that would have been due had there been no problems, to determine if one party owes the other party and how much.

Testify

  • Provide testimony at deposition & trial.
